of our website located at www.throwbackgeeks.com (the "Service") operated by Throwback Geeks.

1. Acceptance of Terms
By accessing and using this website, you accept and agree to be bound by the terms and provision of
this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service
Throwback Geeks is an online store that offers custom designed graphic t-shirts, accessories, and 3D
prints that are either created by us or licensed to sell commercially. Our products cater to individuals
who appreciate pop-art/culture, retro vibe creations, gaming, props, t-shirts, and accessories.

3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and
current at all times. You are responsible for safeguarding the password and for all activities that occur
under your account.

4. Prohibited Uses
You may not use our Service:
• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of
others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code

5. Products and Services
All products and services are subject to availability. We reserve the right to discontinue any product
at any time. Prices for our products are subject to change without notice.
Custom orders are subject to our design approval process and may require additional time for com
pletion. We reserve the right to refuse custom design requests that infringe on intellectual property
rights or violate our content policies.

6. Payment Terms
Payment is due at the time of purchase. We accept various forms of payment as displayed during
checkout. All prices are listed in USD unless otherwise specified. For international orders, prices may
be displayed or charged in other currencies where supported at checkout; otherwise, your payment
provider will convert from USD at its prevailing rate. Your bank, card issuer, or payment service may
charge currency conversion, international transaction, or cross-border processing fees, which are your
responsibility.

7. Shipping and Delivery
Shipping times and costs vary based on location and product type. Custom and 3D printed items may
require additional processing time. We are not responsible for delays caused by shipping carriers or
customs procedures. International customers are responsible for any customs duties, import taxes (in
cluding VAT/GST), brokerage, or other fees assessed by destination authorities or carriers. These
charges are not included in our prices or shipping rates and are payable by the recipient upon deliv
ery. Due to legal, logistical, or carrier limitations, we may restrict or suspend shipping to certain coun
tries, regions, or addresses (including embargoed, sanctioned, or remote locations). If we cannot ship
to your address, we will notify you and issue a refund for any amounts paid for unshipped items.

8. Returns and Refunds
Our return and refund policy is governed by our separate Return and Refund Policy, which can be
found on our website. Custom and personalized items may not be eligible for return unless defective.

9. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive prop
erty of Throwback Geeks and its licensors. The Service is protected by copyright, trademark, and other
laws. Our trademarks and trade dress may not be used without our prior written consent.
All custom designs created by Throwback Geeks remain our intellectual property unless explicitly
transferred to the customer in writing. Licensed designs are used in accordance with their respective
licensing agreements.

10. User-Generated Content
By submitting content to us (including custom design requests, reviews, or feedback), you grant us a
non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display such content
in connection with our business operations.

11. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the
Service.

12. Disclaimers
The information on this website is provided on an "as is" basis. To the fullest extent permitted by law,
this Company excludes all representations, warranties, conditions, and other terms which might otherwise be implied by statute, common law, or the law of equity.

In no event shall Throwback Geeks, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, punitive, special, or consequential damages, including with
out limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of
the Service.

You agree to defend, indemnify, and hold harmless Throwback Geeks and its licensee and licensors,
and their employees, contractors, agents, officers and directors, from and against any and all claims,
damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

15. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior
notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

16. Governing Law
These Terms shall be interpreted and governed by the laws of the State of Illinois, United States, with
out regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms
will not be considered a waiver of those rights. These Terms are provided in English, which is the con
trolling language for all purposes.

17. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision
is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

18. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed
and interpreted to accomplish the objectives of such provision to the greatest extent possible under
applicable law and the remaining provisions will continue in full force and effect.

20. International Customers and Compliance
• You are responsible for ensuring that your purchase and use of our products comply with the laws
and regulations of your local jurisdiction, including import and export controls.
• Customs duties, import taxes (including VAT/GST), brokerage charges, and any other fees imposed
by destination countries or carriers are the buyer's responsibility. See Section 7 for additional ship
ping details.
• Currency and fees: Prices are shown in USD unless otherwise indicated. Where available, we may
display or accept payment in other currencies at checkout. Your payment provider may apply its
own exchange rates and charge currency conversion, international transaction, or cross-border
fees.
• Shipping restrictions: We may restrict or suspend shipping to certain countries, regions, or ad
dresses where prohibited by law, embargo, sanction, or carrier limitations.
• Language and governing law: These Terms are provided in English and governed by the laws of
the State of Illinois, USA (see Section 16).
• Dispute resolution: We aim to resolve issues amicably—please contact support first. If we cannot
resolve a dispute within 30 days, and unless prohibited by mandatory local law, disputes may be
brought in the state or federal courts located in Illinois, USA. Consumers outside the United States
retain any non-waivable rights provided by the mandatory laws of their country of residence.
